DISTANCE ELECTRONIC TICKET SALES AND PASSENGER TRANSPORTATION CONTRACT
ARTICLE 1 - PARTIES:
ARTICLE 1.1- İZDENİZ :

Hereinafter referred to as "İZDENİZ".
ARTICLE 1.2- PASSENGER :
The person who purchases the passenger transportation ticket from the website "https://bilet.izdeniz.com.tr/" is the person whose name is mentioned on the ticket and to whom the passenger transportation service will be provided, in line with the information entered on this website. Hereinafter referred to as “PASSENGER”.
If the credit card holder and the person who will receive the ticket service are different persons, both the person who owns the credit card on which the ticket price is paid and the person who will receive the service are the PASSENGER parties of this contract. According to this agreement, both persons declare and undertake that they will fulfill the rights and obligations arising from this agreement by gaining the title of PASSENGER.
The PASSENGER declares and undertakes that the information provided is correct, that it will comply with all the rules specified in this agreement during the service provided and that it will fulfill all the acts of this agreement.
ARTICLE 2- WEB SITE:
The address of the website where İZDENİZ sells the "passenger transportation ticket" under the provision of this contract is "https://bilet.izdeniz.com.tr/".
All tickets notified to be sold by İZDENİZ other than this website are invalid.
“https://bilet.izdeniz.com.tr/” will hereinafter be referred to as the “website” in this agreement.
ARTICLE 3- SUBJECT OF THE AGREEMENT:
The subject of this agreement is to determine the procedures and principles regarding the passenger transportation ticket sales made by İZDENİZ to the PASSENGER electronically via the website https://bilet.izdeniz.com.tr/ and the passenger transportation service it provides to the PASSENGER. In this regard, the provisions of the Law on Consumer Protection No. 4077 ("Law") and the Distance Contracts Regulation dated 27.11.2014 ("Regulation") and the Regulation No. 31932 dated 23.08.2022 are taken as reference.
ARTICLE 4- GOODS/PRODUCT/SERVICE INFORMATION AND DELIVERY SUBJECT TO THE CONTRACT:
The services subject to this contract are the sale of electronic tickets through the website on passenger transportation by ship and the provision of passenger transportation services to the PASSENGER for whom an electronic ticket is issued. Ticket information includes the following;
İZDENİZ's name, title, full address, telephone, internet access information, MERSIS number, basic characteristics of the service subject to the contract, sales price, payment method, boarding place, destination,
travel date, departure time, information at the time the order is finalized on İZDENİZ's website.
The ticket is also sent to the PASSENGER's e-mail address. The PASSENGER is deemed to have received the ticket subject to the contract as soon as he/she finalizes the ticket order specified in this contract via the website. Upon delivery, he/she is deemed to have accepted and undertaken to comply with the rules in the contract and fulfill his/her duties.
ARTICLE 5- COMMITMENT AND RESPONSIBILITY OF THE PASSENGER:
The PASSENGER gives the necessary confirmation electronically that he/she has read all the information regarding the basic characteristics of the passenger transportation ticket subject to this contract, passenger transportation rules, sales price and payment method and delivery. The PASSENGER accepts and undertakes that he/she has read this contract and the passenger transportation rules as soon as he/she purchases the ticket, will comply with all the rules in the contract and will fulfill all his/her actions.
PASSENGER accepts and undertakes that if he/she does not comply with the rules specified in this agreement and does not fulfill his/her actions in accordance with the rules specified in the agreement, İZDENİZ, with all rights reserved, may terminate this agreement immediately without any requirement for notice.
All damages arising from the PASSENGER's failure to comply with this agreement belong to the PASSENGER.
Tickets purchased in accordance with this agreement are only at the disposal of the person named on the ticket and can be used personally. The PASSENGER accepts and undertakes that the information entered on the website is correct and that he/she has purchased a ticket to be used by the person named on the ticket. If it is determined that the person named on the ticket and the person who wants to receive the service are different, the PASSENGER accepts and undertakes that İZDENİZ has no liability arising from this agreement and may terminate this agreement without any notice.
ARTICLE 6 - RESERVATION, TICKET AND TRANSPORTATION RULES:
1 – Tickets are personal and cannot be transferred to anyone else.
2 – No reservation changes can be made, no tickets can be canceled and no refunds will be made after the scheduled departure time.
3 – The PASSENGER agrees to comply with the on-board regulations and captain's instructions.
4 – The PASSENGER must be present at the port at least 1 hour before the ship's departure time.
5 – İZDENİZ reserves the right to make any changes in the sailing schedule.
6 – Any disputes regarding transportation are resolved in Izmir Courts in accordance with the current tariff conditions and Turkish Laws and Regulations.
7 – Voyages may be suspended, changed or extended due to bad weather, sea conditions or problems beyond İZDENİZ's control. İZDENİZ is not responsible for any expenses or negativities, including transportation, accommodation and food expenses, that may arise from these and similar delays and cancellations that are beyond the control of İZDENİZ.
8 – Children under the age of 16 can only travel with a companion. According to İZDENİZ rules, the acceptance of unaccompanied children, passengers in need of assistance, pregnant women or sick people for transportation can only be subject to prior agreement and arrangements with İZDENİZ. İZDENİZ is not responsible if the passenger's health condition deteriorates during travel.
9 – İZDENİZ does not accept liability for any injury or death, damage or loss to luggage or personal belongings, unless it is proven by the judicial courts established in Izmir that it is caused by İZDENİZ's fault or negligence. İZDENİZ does not accept liability if injury, death, loss or damage occurs due to terrorism, riot, civil war, natural disaster, bad sea and weather conditions or malicious acts of third parties.
10 – The carrier cannot be held responsible for passenger belongings lost on ships.
11 – The ticket fee is only for transportation between the departure port and the arrival port. Tickets can only be used for the itinerary specified on them. The itineraries on the tickets cannot be changed at all.
12 – If the fee is paid in a currency other than the declared currency, the evaluation will be made based on the Central Bank Foreign Exchange Buying Rate at the time the electronic ticket was purchased.
13 – There is no guarantee of a specific seat number on the ship.
14 – Greece does not require a visa from Green and Gray Passport holders.
15 – Normal passport holders must have a valid Schengen Visa or gate visa for the duration of the journey.
16 – Turkish Citizens who have a TRNC entry stamp in their passports cannot travel to Greece with these passports.
17 – It is dangerous and prohibited for passengers to board or disembark the ship without the ramp being fully opened during boarding and disembarkation and without the ship personnel giving boarding or disembarking approval and without taking the necessary safety precautions.
18 – If the passenger acts within the ship in a way that endangers the ship or any person or property, or prevents the ship's personnel from performing their duties, or does not comply with the instructions of the ship's personnel, or causes reasonable objections from other passengers; İZDENİZ may take any measures it deems necessary to prevent the continuation of such behavior, including restraining the passenger.
19 – Passengers must not leave their seats during take-off and docking manoeuvres. Passengers must comply with the warnings announced during the cruise. İZDENİZ cannot be held responsible for any injuries or material damages that may result from failure to comply with these rules.
20 – İZDENİZ will be responsible only if the passenger or baggage is damaged due to its own fault. If the passenger is at fault, İZDENIZ's liability may be reduced or eliminated subject to the provisions of the legislation.
21 – İZDENİZ will not be responsible for any damage to fragile and perishable items, money, jewellery, precious metals, silverware, bills or other commercially valuable papers, passports and other IDs or copies in the baggage.
22 – During the transportation of a passenger whose age, mental or physical condition creates danger or risk for himself, İZDENİZ will not be responsible for any illness, injury or disability, including death, of this passenger due to the above-mentioned conditions or as a result of the aggravation of these conditions.
23 – To facilitate your check-in process at the ports, please do not forget to print out your online ticket.
24 – Passengers with one-way tickets who are not allowed to enter Greece must purchase tickets for their mandatory return journey.
25 – Passengers with one-way tickets who are not allowed to enter Turkey must purchase new tickets for their mandatory return journey
26 – Passenger, hereby undertakes and accepts that there is no validity period, scope, date, number of entries, duration of stay or any similar elements in his/her passport, visa, residence permit or other travel documents that would prevent him/her from entering Greece, and that he/she will personally pay the fine imposed by Greece in case of any such penalty and that he/she has been informed about this issue publicly.
27 – For round-trip tickets falling in different seasons, the seasonal price of the departure date is applied.
ARTICLE 7 - REJECTION AND LIMITATION OF TRANSPORTATION
İZDENİZ may refuse to carry passengers and/or passenger luggage in the following and similar cases for security reasons or by using its discretion:
– Passenger behavior, age or mental or physical condition,
– If it requires special assistance from İZDENİZ,
– Causes inconvenience or objections to other passengers or poses any risk or danger to other persons or property,
– If the passenger's failure to comply with İZDENİZ's instructions makes such a rejection necessary,
– If the passenger has refused the security check,
– If passengers are under the influence of intoxicants and/or drugs and arrive at the boarding terminal in a way that affects the safety and comfort of other passengers and the cruise,
İZDENİZ will not refund the ticket price to passengers whose transportation is refused and no compensation will be paid in any way.
ARTICLE 8 - ITEMS NOT ACCEPTED AS BAGGAGE:
1 – It is forbidden to carry firearms and ammunition as baggage.
2 – İZDENİZ may refuse to carry any object as baggage due to its size, shape, weight and nature.
3 – İZDENİZ may refuse to carry the baggage if it is not placed in bags, suitcases or other suitable containers to ensure safe transportation with normal care.
4 – Passengers have free baggage allowance.
5 – Prohibited substances such as drugs are never transported. If it is detected that it has been carried, the responsibility lies entirely with the carrier.
ARTICLE 9 - CANCELLATION OF THE TRIP AND REFUND CONDITIONS:
1 – İZDENİZ, provided that the ticket cancellation request is notified in writing to the e-mail address acente@izdeniz.com.tr 24 hours before the departure time: the ticket may be suspended once, the date may be reassigned, or a refund will be made in the same way as the ticket payment was made.
ARTICLE 10 – PET TRANSPORTATION
1 – It is not possible to travel with pets.
ARTICLE 11 - WEBSITE TERMS OF USE:
1 – All rights and disposition authority of the website subject to this agreement belong to İZMİR DENİZ İŞLETMECİLİĞI NAKLİYE VE TURİZM TİC A.Ş. (İZDENİZ), and the person who enters and uses the website is deemed to have accepted the terms of use and contract of the site. İZMİR DENİZ İŞLETMECİLİĞİ NAKLİYE VE TURİZM TİC A.Ş (İZDENİZ) reserves the right to change any information on the site, including the contract terms. Changes come into force as soon as they are published on the site.
2 – Reservation and ticket conditions are published on our website.
3 – It is possible to provide links to other sites through the website. İZMİR DENİZ İŞLETMECİLİĞİ NAKLİYE VE TURİZM TİC A.Ş (İZDENİZ) does not guarantee the accuracy of the information on the linked site and does not make any commitments. Any damages that may arise from the use of these sites are the user's own responsibility.
ARTICLE 12- CONFIDENTIALITY
Article 12.1 Confidentiality Policy
Personal information transmitted to İZDENİZ (İZMİR DENİZ İŞLETMECİLİĞİ NAKLİYE VE TURİZM TİC. A.Ş.) is used within the scope of the conditions stated in the Privacy Policy section.

Article 12.3 Personal Information Collection Procedure
PASSENGER accepts that the information obtained through our website will be used to determine the security and accuracy of the transactions made by İZMİR DENİZ İŞLETMECİLİĞI NAKLİYE VE TURİZM TİC A.Ş., as well as affiliated companies, partners and agencies. It is mandatory to provide some personal information, which may vary depending on the product or service requested, including but not limited to information such as name, surname, identity document number, address, credit/debit card numbers, expiration date, security number, passport number, nationality. Failure to provide the information required for İZDENİZ to continue operations may prevent the service that should be provided to the PASSENGER. PASSENGER information can only be used for the specified purposes:
– Processing reservations and sales and managing the PASSENGER account.
– Marketing of services and related products.
– Making statistics about transactions.
– Creating connection lists to ensure the continuation of the connection with the PASSENGER,
– Combining commercial statistics and analyzes regarding site usage.
– Authentication and registration creation.
The forms used to send information to İZDENİZ are protected by SSL technology during the transmission. Even after the data reaches İZDENİZ, it is protected by strict security and confidentiality standards, which is always essential for İZDENİZ.
In order to benefit from the SSL encrypted message service, the browser must support SSL and the SSL option must be activated. The data entered by the PASSENGER is stored by İZDENİZ during the transactions and legal requirements. The site is constantly being developed and there are also developments regarding data usage. Any developments will be reported on the website under the heading "KVKK Notification".
Article 12.4 Confidentiality of Your Reservation Records
When a reservation is made, the PASSENGER will be given a reservation code (PNR). This booking code must be kept confidential at all times. If the reservation code given to the PASSENGER is not kept confidential, the reservation information can be accessed by others. If a group reservation is made to travel with more than one person, the same reservation code will appear on the tickets of other people in the group. If these people do not want to have access to their personal reservation information, the option of making a individual reservation can also be taken into consideration. Any liability arising from not keeping the reservation code confidential belongs to the PASSENGER, and İZMİR DENİZ İŞLETMECİLİĞİ NAKLİYE VE TURİZM TİC A.Ş. has no responsibility for third parties accessing the reservation code.
Article 12.5
PASSENGER should not share credit card information with others. The PASSENGER accepts that he/she will be personally and solely responsible for the security of this information, and that İZDENİZ will not be responsible in any way for the use of credit card information by anyone other than him/her. PASSENGER hereby accepts and declares that İZDENİZ has no direct or indirect liability for all negligence and faults in matters such as the security of credit card information, storage, keeping it away from third party information and use, and to compensate İZDENİZ for any damage suffered due to its negligence or fault.
ARTICLE 13 - AUTHORIZED COURT, APPLICABLE LAW
Turkish Law applies to any disputes that may arise from this agreement.
Izmir Courts and Enforcement Offices are authorized to resolve disputes.
ARTICLE 14 - AMENDMENT
İZMİR DENİZ İŞLETMECİLİĞİ NAKLİYE VE TURİZM TİC A.Ş (İZDENİZ) may change part or all of this distance sales agreement when deemed necessary.
ARTICLE 15 - PROVISION
If the order is finalized, the PASSENGER will be deemed to have accepted all the conditions of this agreement. If any provision in this contract consisting of 15 articles is invalid or unenforceable, it will not affect the validity of the other provisions of the contract.
